Sheesh.. he's arguing semantics. I think he is trying to claim that if the person hasn't been tried and found guilty, it can't be "punishment".
They are just "getting information" which is not "punishment".

Freaking scary.

and obviously you CAN be cruelly and unusually questioned.. because it's not punishment, which is the only thing mentioned that CANNOT be cruel and unusual.

I saw this on The Daily Show last night...but I HATE when anybody forms opinions from a sound byte. So watched the entire 60 Minutes interview and I was BEYOND uncomfortable during the whole thing...then this piece just blew me out of the water!

Thought: Should I be embarrassed that I just admitted to getting my news info from Comedy Central????
